Terms and Conditions of Sale (T&Cs)

2. Description of Products

Neural Artistry offers two types of products:

a. Digital Products:
  • Downloads of high-definition digital artworks, with details (formats, resolutions, etc.) provided on each product page.
  • Standard License: Digital files are strictly for personal use only. Any reproduction, distribution, publication, or commercial use is prohibited without prior authorization.
  • Commercial License: Any use for commercial purposes requires a specific license, negotiated on a case-by-case basis via the contact form.
b. Physical Products:
  • Printed posters (with or without frames), with details provided on each product page (dimensions, materials, finishes, customization options).
  • Customization:
    • A preview will be sent for approval before production.
    • The customer has a maximum of 7 business days to validate or request changes.
    • If no response is received within this time, the preview will be considered approved, and production will proceed.

3. Pricing

  • Prices are listed in euros including VAT (Value Added Tax) and exclude delivery charges unless otherwise stated.
  • Delivery charges vary depending on the destination country and are displayed before order confirmation.
  • Neural Artistry reserves the right to modify prices at any time. However, products will be invoiced based on the price in effect at the time of order placement.

4. Payment Terms

  • Payments are secured and can be made via:
    • Stripe (credit cards: Visa, Mastercard, etc.).
    • Other methods specified at the time of order confirmation.
  • Payment is required at the time of order. Digital products will be available for download, and physical products will be shipped only after payment confirmation.

5. Delivery Times and Methods

a. Digital Products:
  • Available immediately after payment confirmation via a download link sent by email.
  • Download links remain valid for 30 days.
b. Physical Products:
  • Shipped within 5 to 7 business days after order or customization approval.
  • Deliveries are limited to European Union (EU) countries. Orders outside the EU are not supported.
  • Delivery times vary depending on the destination country and chosen carrier. Neural Artistry cannot be held liable for delays attributable to the carrier.

6. Returns Policy and Right of Withdrawal

a. Digital Products:
  • In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital products once downloaded. By confirming the purchase, the customer expressly waives this right.
b. Physical Products:
  • Customers have a period of 14 days from receipt to exercise their right of withdrawal without providing a reason. Return shipping costs are the responsibility of the customer.
  • Customized products cannot be returned or refunded unless they are defective or non-compliant.
  • Returned products must be in their original condition and accompanied by proof of purchase.

7. Clause on Defects and Damage During Transport

  • Neural Artistry guarantees that physical products shipped are as described and carefully packaged.
  • If damage is noted upon delivery (e.g., damaged poster, torn packaging), the customer must:
    1. Make specific notes on the delivery slip or refuse the package.
    2. Notify Neural Artistry within 48 hours via the contact form, providing photos of the damaged package and product.
  • Replacement or Refund:
    • Upon validation of the claim, Neural Artistry will replace the product free of charge or refund the order, at the customer’s choice.
    • Damage resulting from misuse or negligence by the customer is not covered.

8. Intellectual Property Rights

  • All works available on the Neural Artistry website are protected by copyright laws.
  • The purchase of a digital or physical product does not transfer any copyright ownership.
  • Customers receive a limited personal use license or a specific commercial license, as applicable.
  • Any unauthorized reproduction, distribution, or exploitation is strictly prohibited and may result in legal action.

9. Personal Data

  • Personal data collected during orders is processed in accordance with our Privacy Policy.
  • Customers have the right to access, rectify, and delete their data in accordance with the GDPR.

10. Governing Law and Dispute Resolution

  • These T&Cs are governed by French law.
  • In the event of a dispute, an amicable solution will be sought as a priority. If no agreement is reached, the dispute will be submitted to the competent courts of Grenoble, France.
